Napa cult murderer found not guilty by insanity

A Napa County jury on Thursday found Alex Taylor not guilty by reason of insanity in the shooting of George Davis last spring.

Taylor, 26, showed little emotion as the court clerk read the verdict Thursday morning. The decision means Taylor will be housed in a mental institution for what could be the rest of his life.
Court officials will decide exactly what will happen to Taylor at a May 29 hearing.

On April 30, the same jury found Taylor guilty of first degree murder, sparking the insanity phase of the trial to determine whether Taylor would spend time in prison or a mental institution.
The jury came to its second verdict after days of testimony by mental health experts.

Prosecutors and the defense both agreed that Taylor was mentally ill, most likely suffering from schizophrenia. Taylor has said he suffers from the disease.
“I think he was mentally ill,” Napa County Deputy District Attorney Gary Van Camp said after the verdict,” (But) I think he knew what he was doing was morally wrong.”

Experts testifying on the matter were split, but Deputy Public Defender Jess Raphael said the jury’s verdict clearly indicated that jurors were swayed by defense experts.

“Numerically they were split, but by quality and persuasiveness of their opinions there was no contest,” he said. “This is the right result.”

Raphael described Taylor as a “good kid” who had no prior record before the murder and suffered from mental illness.

Part of Taylor’s defense focused on Davis’ study of so-called black magic and his efforts to bring youths like Taylor into a cult based on his teachings. Raphael argued that Taylor believed Davis, 62, had special powers over him and the demons inside Taylor’s head had taken on the identity of Davis — prompting an internal struggle to rid Taylor’s body of Davis’ spirit, culminating in Davis’ murder.

Van Camp has said there were more terrestrial motives for Taylor to shoot Davis, including that Taylor owed Davis $6,000 and he believed Davis raped him when he was 4 years old.

The prosecution said the night of the shooting, Taylor planned out how he would execute Davis. Van Camp said Taylor armed himself with a rifle, went to Davis’ apartment and talked him into going into the bedroom where he shot him once in the back and then four more times in the head.

" Winning an insanity defense in a murder trial is like the Holy Grail to defense attornies. Congratulations, Jess. Although there will be no living with you from now on! LOL!!!

I pray that Mr. Taylor is truly in need of help and that he actually gets the help he needs from the state instead of him being over-medicated and wharehoused away like so many others. "

" Once again, somebody found NGRI CAN be kept longer than their max sentence if they are still mentally ill and dangerous. Misinformation like this only causes people to freak out unnecessarily because they think that this guy will be roaming the streets at some point. In reality, he may be kept inside the state hospital system forever. "

" Is there a more appropriate way to treat a violent schizophrenic than long-term confinement and use of medication that reduces the symptoms of this (in his case) severe mental illness? "

" Congrats to all involved. To answer everyone's questions- Yes, Mr. Taylor IS truly in need of help. I do not believe that he has ever had proper treatment for his illness. I have known him for many, many years and am happy to know that he will finally be able to get the help that he needs. He is a nice young man- despite what you all may get from this, and deserves some help. "

" What Napa taxpayers should be concerned with is that the facts of this case clearly show both the defendant and the victim were nuts. Why did we spend all this money prosecuting the defendant? This should have been resolved. "

" It's kinda weird to me. I believe Mr. Davis was guilty. He paid the ultimate price for that. That being said, why should Mr. Taylor be punished for doing the "right thing"? It's not likely that the police would've listened to his story in the first place. They pegged him insane from the get-go. A biased opinion. Dang, where's the fair shake in that? My point?....set Al free. "

" I am very satisfied with the insanity verdict and believe that Mr. Taylor received a very just jury in this case. It's too bad more trials are not handled as well as this one was. Now he will (hopefully) receive the help he so desperately needs and who knows, maybe someday he will be able to become a mentally capable and productive member of society.. "

" As I understand it, the prosecution was offered an insanity deal months ago, long before trial. Why the hell didn't they just do what EVERYONE agrees was the right thing and save the Napa community a trial that must have cost hundreds of thousands of dollars?!?

Maybe we should check the recent Chronicle and see how much money the prosecutor made in overtime salary last year!! he must have made a mint over the past year.

Disappointed taxpayer "

" Where to begin...I have been reading everyone's comments since this all started and suffering in silence. I can't do that anymore. George Davis was a member of my family. I do not deny for one second that he was different. His beliefs and his lifestyle were certainly not what would be considered mainstream. That being said, George was a kind and generous person who would've given any one of you the shirt off his back if you needed it. His character has been assassinated since this ordeal began. Jess Raphael has taken many pieces of George's life and exploited them in an unfair and misleading context. George has not been here to defend himself because Taylor MURDERED him. Need I remind you all that George is the victim here? I can't believe some of the cold and ignorant comments I have been reading on this article alone. "The facts of this case clearly show both the defendant and the victim were nuts." Are you kidding me? What do you know about the FACTS? You know what Jess Raphael has been presenting to defend a MURDERER. Don't confuse that with FACTS. "I believe Mr. Davis was guilty...That being said, why should Mr. Taylor be punished for doing the "right thing"?" RIGHT THING??? Do you think anyone who is not Christian can be executed and it's the "right thing?" What about Buddhists? Or Jews? Muslims? Just because a man has different religious beliefs than you doesn't make him a monster. George never hurt anyone. This is America and Freedom of Religion is a fundamental right. Not "everyone" agrees Taylor is insane. I'm sorry your tax dollars were wasted in an attempt to convict a cold blooded murderer. You all should be ashamed of yourselves. "

" Most heartfelt condolences to any of Mr. Davis'a family. Your sense of loss and frustration are totally understandable. It would appear that Mr. Taylor may not have had the ability to assess his own perceptions the way you and I would. If he is mentally ill he can probably only be treated and not cured. He will need to be housed in a maximum security facility for the criminally insane. "

" Jess Raphael=ROCK STAR!
Alex Taylor is very lucky to have Raphael defend him. Very lucky to get Napa Public Defender to fight for his rights. They are the best in the state and we are lucky to have them right here in Napa to uphold the Constitution. Nobody better to fight for his rights than Raphael. Jess puts the "Z" in zealous. Congrats, Jess, and all the best to Taylor. "

" For all the people complaining about waste of our taxes:
Let's vote Lieberstein out!
Jess Raphael for District Attorney!
Let's get some fairness and efficient use of our taxes, and a fight for our rights that is Raphael's passion. He is the best lawyer in town. He holds up the Constitution so that the rest of us can live in "freedom" (or whats left of it). "

" outoftowner, I hope this response goes through this time. I'm sorry for your loss. I agree with everything you said in your post. Yes, I do believe we still live in a world which discriminates if you do not fit into a certain religious mold. And it's worrisome that a jury can be manipulated with this tool.

The part that bothers me is that Taylor (and his attorney) implied that Taylor "thought" he was molested by Davis as a toddler. A seed was planted in the minds of the jury based on "thought". How come our judicial system allowed that statement to be admitted? Because Davis was painted as a dark character and it was ok to pile more unproven stuff on top? I feel as though we have stepped backward, not so far as the Salem witch trials, but certainly in that direction.

"

" George P. Davis was my brother. He may have had an "alternative" sense of religion, but he would never harm another human being.

I believe in the constitution, and everyone is entitled to the best defense possible. However, doing one's best to defame a dead man, no matter how rich a fantasy life he may have had, is reprehensable.

I have nothing but the highest regards for the jury in this case. Sorting out the facts from the fluff must have been difficult at best. May they all go on with their lives peacefully knowing all living family members support them.

My feelings toward the Napa legal team are of the highest order. They faced a situation in which it would be easy to "write George off as a nut" and put their resources elsewhere could have been an easy one. Yet I believe also, that every victim deserves the best prosecution provided under the constitution as well.

Napa: PAX VOBISCUM. You now know how even the least of these are your brother, and evil can be found wherever you look (if you look long and hard enough). "
